The WCDoA acknowledges the growing concern regarding the employment of undocumented foreign nationals, particularly within the agricultural sector. In the current environment, it is essential that employers and producers are equipped with accurate information to ensure lawful and responsible employment practices.

While the enforcement of immigration legislation falls within the mandate of the Department of Home Affairs (DHA), and labour compliance within the Department of Employment and Labour (DEL), the WCDoA continues to play a proactive role in raising awareness, supporting compliance, and facilitating stakeholder engagement on this matter.

Through this work, the Department has developed the Practical Guide on the Employment of Foreign Nationals. This user-friendly resource provides clarity on legal requirements, outlines key definitions, and offers guidance on appropriate procedures, along with contact details for relevant authorities.
